The City of San Antonio has established rules to maintain the health, safety and appearance of the city.  These rules are embodied in the City Code, and are referred to as the Code. In addition, the deed to each piece of property in Whispering Oaks contains rules, referred to as covenants or deed restrictions, which are concerned with keeping an attractive, desirable neighborhood.  The following is a summary of the most common section of the City Code and Covenants applicable to Whispering Oaks.  Further information may be obtained from the appropriate Board member.

Alterations

No Buildings shall be erected, placed or altered until plans have been approved by the Architectural Committee (Covenant).

Antennas

Radio and television antennas shall not project more than eight feet above the highest part of the roof.  They shall not be located nearer than ten feet to the front wall line of the dwelling (Covenant).

Garage

Each dwelling must have a two car garage or carport (Covenant).

Garbage

Household garbage should be placed in receptacles for collection and placed at a location accessible to garbage collectors.  After receptacles have been emptied by the collectors, it is unlawful to allow receptacles to remain on any street or sidewalk (Sec. 187).  Garbage receptacles must be kept clean (Covenant).

Home Business

No business may be opened in an area zoned R-1 except for certain restricted home occupation such as dressmaking, milliner, tailoring, sewing, washing, or ironing shops.  When a home business is allowed, the residential architectural appearance of the dwelling must not be changed, the business must not utilize more than 25% of the gross floor area of the main structure, and no person not residing on the premises may be employed in the business.  There are strict limitations on the signs relating to such home occupations (Sec. 42-7).

Nuisances

No noxious or offensive activity shall be carried on upon any lot, or shall anything be done thereon which may be or may become an annoyance or nuisance to the neighborhood (Covenant).

Parking of Boats or Trailers

No boat, trailer, camper body, or similar vehicle shall be parked for storage in the driveway or front yard of any dwelling unless parked to the rear of a screened fence (Covenant).

Parking of Vehicles

It is unlawful for any person to park unused cars in the street or public place for more than 24 hours, or at anytime for the purpose of storage, washing, greasing or repairing such vehicles (Sec. 38-84).

Pets

All dogs must be kept under restraint at all times (Sec. 6-25).  An animal repeatedly without a leash or not under the owner's control while outside the owner's premises constitutes an animal nuisance (Sec. 6-1 [5]).  No animals of any kind may be raised, bred or kept on any lot, except that household pets are permitted provided they are not kept or bred for commercial purposes (Covenant).

Temporary Structures

No structure of a temporary character, trailer, basement, tent, shack, garage, barn, or other out-building shall be used on any lot as a residence either temporarily or permanently (Covenant).

Yards

Homeowners shall keep weeds and grass in their lots cut and kept in a sanitary, healthful and attractive manner (Covenant).
